Gallagher Premiership Rugby Final 2023 Ticket Terms & Conditions
1.1 What these terms cover. These terms and conditions constitute the legal terms and conditions that apply to the purchase, transfer, sale and/or use of any ticket to the Gallagher Premiership Rugby Final (“Ticket(s)”). These Terms should be read in conjunction with the RFU’s Twickenham Ground Rules (available here and at englandrugby.com) (the “Ground Rules”) and the RFU’s Spectator Code of Conduct, which apply to all persons who enter the Twickenham Stadium or the car parks operated by the RFU at the stadium and any other property owned or controlled by the RFU in the vicinity of the stadium (the “Ground”).
1.2 Why you shoud read them. Please read these terms carefully before you submit your order to us. These terms tell you who we are, how we will deliver Ticket(s) to you, what to do if there is a problem and other important information. By purchasing, holding and/or using or attempting to use a Ticket you: (i) certify that you have read, understood and accepted these terms and conditions and the Ground Rules; (ii) agree to be bound by and to comply with these terms and conditions and the Ground Rules; and (iii) agree to bring these terms and conditions and the Ground Rules to the attention of others as required by these terms and conditions. A copy of these terms and conditions will be sent to you in an email confirming your purchase of Ticket(s).
1.3 Covid-19. We may need to make a number of changes and additions to these terms and conditions as a result of the Covid-19 pandemic. In such circumstances, any material changes to these terms and conditions will be notified by us to you. Such changes or additions may include restrictions on your attendance at the match, for example, if you have Covid-19 symptoms or have tested positive for Covid-19, a requirement to comply with the NHS Covid Pass or a requirement to comply with a Covid Spectator Code of Conduct. It will not be possible for us to completely eliminate the risk of COVID-19. Therefore, if you are not willing to comply with any of our requirements or you feel uncomfortable with the risk of you attending the match, you should not attend.
2.1 Who we are. We are Premier Rugby Limited a company registered in England and Wales. Our company registration number is 3096937 and our registered office is at Regal House, 70 London Road, Twickenham, Middlesex, TW1 3QS. Our registered VAT number is 661860230.
2.3 How we may contact you. If we have to contact you we will do so by writing to you at the email address you provided to us in your order.
How we will accept your order. Our acceptance of your order will take place when we email you to accept it, at which point a contract will come into existence between you and us. If we are unable to accept your order, we will inform you of this and will not charge you for the Ticket(s).
4. Cancellation, Abandonment and Rescheduling
4.1 You won’t have a right to cancel your purchase and claim a refund under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 other than in accordance with your rights as a consumer under law (for which please contact your local Citizen’s Advice Bureau).
4.2 All tickets are sold subject to licence from the relevant licensing authority and the RFU. We do not guarantee that the Gallagher Premiership Rugby Final will take place at a particular time or on a particular date. We reserve the right to cancel, abandon and/or reschedule the Gallagher Premiership Rugby Final to comply with the rules of the game of Rugby Union or where we otherwise need to do so. In such event:
a) if the Gallagher Premiership Rugby Final is cancelled or abandoned before kick-off and not rescheduled and you have purchased your Ticket(s) for the match directly from us, you can apply to us for a refund within 30 days of the date on which the match is cancelled or abandoned and we will refund the amount you have paid for your Ticket(s) (up to a maximum of the face value of the Ticket(s)) within 30 days of receipt of your refund application.
b) if the match is abandoned before kick-off, and it is possible to reschedule the match or the date of a match is changed after you have purchased Ticket(s) for it, you will be entitled to Ticket(s) to attend the rescheduled match or, if you are unable to attend the rescheduled match you will be entitled to a refund of amount you paid for your Ticket(s) (up to a maximum of the face value of the Ticket(s)). In the event that an abandoned match is rescheduled or we change the date of a match, we will notify you of the process and deadline for obtaining Ticket(s) for the rescheduled match or a refund.
4.3 Subject to clause 9.3, we and/or Ground owner will have no further liability whatsoever, including (but not limited to) any indirect or consequential loss or damage, loss of enjoyment or travel or accommodation costs.
5. Use of Ticket(s)
5.1 Every Ticket remains our property at all times.
5.2 Any person who enters the Ground including children (babes in arms may be permitted access with express authorisation from PRL) must have a valid Ticket. Persons under the age of 16 must be accompanied by a responsible adult over the age of 18.
5.3 Admission to the Ground is by the entrance shown on the Ticket and cannot be guaranteed if the Ticket holder arrives less than 45 minutes before the advertised commencement or kick off time. A Ticket permits you to occupy, at the relevant Match (but not otherwise), the seat indicated on that Ticket or such other alternative seat as we or the Ground owner/operator may allocate to you, acting reasonably.
5.4 Your Ticket will entitle you to gain admission to the Stadium only after it has been validated by the control readers located at the appropriate turnstiles. You may be refused admission to the Stadium if your Ticket is not validated by such control readers.
5.5 If you leave the Ground before the end of the match re-admission is at our discretion.
5.6 Ticket holders’ access to the Ground is for the purposes of private enjoyment of the match only and not for any commercial purpose. You agree not to bring into, use or display within the Ground any sponsorship, promotional or marketing materials.
5.7 Any person who enters the Ground is liable to be searched by a police officer or by our employees or agents for health and safety reasons and to ensure they are complying with these terms and conditions and the Ground Rules in relation to items that cannot be brought into the Ground. We reserve the right to refuse admission to anyone who refuses to be searched.
5.8 The Ground Rules contain a list of items that may not be brought into the Ground and a non-exhaustive list of reasons why we may refuse a Ticket holder admission to the Ground or eject a Ticket holder from the Ground.
5.9 Whilst in or around the Ground you must:
a) comply at all times with the Ground Rules;
b) answer promptly and truthfully any question concerning your Ticket from our employees or agents or a member of the police; and
c) not offer or distribute (either free or for sale) within the Ground any articles, materials, products or services of any nature nor conduct any charitable or other collection without our prior written authorisation.
5.10 Mobile telephones and other mobile devices are permitted within the Ground, provided that they are used for personal and private use only (which shall not include the capturing, logging, recording, transmitting, playing, issuing, showing, or any other communication of any audio, visual or audio-visual material or any information or data of any nature for any commercial purposes). The capturing, logging, recording, transmitting, playing, issuing, showing, or any other communication of such material for any commercial purposes is strictly prohibited.
5.11 Whilst in or around the Ground you acknowledge that photographic images and/or video recordings and/or stills taken from those video recordings may be taken of you and may also be used, by way of example, in televised coverage of the match or by us (or our commercial partners) for any purpose deemed reasonable by us, including, without limitation, for marketing, training or promotional purposes. Your entry into the Ground is confirmation that you have consented to such use of your image. If you are under 16 years of age either the parent, guardian or responsible adult who is accompanying you into the Ground shall be deemed to have provided consent on your behalf.
5.12 Children’s tickets are only available to individuals under 16 years old. We reserve the right on purchase, entry to the Ground or at any other point to ask anyone using a child’s ticket to provide photographic evidence of their age and may cancel or withdraw any child’s ticket that is being used, or is intended to be used, by someone aged 16 years or older.
5.13 If you are under 16 years old, your parent(s) and/or guardian(s) are jointly responsible with you for your actions, conduct and compliance with these Terms.
5.14 Where a Ticket has been lost or stolen, you must notify us immediately and we shall, subject to ascertaining and verifying the circumstances in which you were in possession of the Ticket and of the loss or theft of the Ticket, issue you with a duplicate Ticket. If we issue you with a duplicate Ticket, the original Ticket will become automatically invalid.
6. Transfer of Ticket(s)
6.1 If you have purchased a Ticket and are unable to attend the match, you will only be able to transfer your Ticket to a third party if it is carried out via Premiership Rugby’s official online resale platform (“Ticket Exchange Platform”) and provided it is not sold above face value. Ticket(s) may not be sold through secondary ticketing service providers, auction sites, or websites other than the Ticket Exchange Platform.
6.2 You will be able to list your Ticket for resale on the Ticket Exchange Platform once the Ticket Exchange Platform has been opened by us for the match. We reserve the right to determine if and when the Ticket Exchange Platform will open.
6.3 The terms and conditions that apply to the Ticket Exchange Platform will be available on the Ticket Exchange Platform when it is opened by us.
6.4 Ticket(s) may not be used as a prize or as part of any competition or promotional or other similar activity or as part of any hospitality or travel or other commercial package, sold as part of a package.
6.5 Any Ticket that is (or that we reasonably believe is intended to be) transferred or sold, or offered for sale or transfer, in breach of these Terms will be void and treated as an Unlawful Ticket and all rights conferred by the Ticket will automatically cease and terminate. We may seize the Ticket and refuse admission to the Ground and/or eject from the Ground any person in possession of an Unlawful Ticket without refund or compensation. We may also bar any person in possession of an Unlawful Ticket from attending Matches or other events at the Stadium in the future.
7.1 Delivery costs. Any costs of delivery will be as displayed to you on our website.
7.2 When we will provide the Ticket(s). Tickets will be delivered to you in electronic format between two and four weeks prior to the match or in such other format as we may determine.
7.3 We are not responsible for delays outside our control. If our delivery of the Ticket(s) is delayed by an event outside our control then we will contact you as soon as possible to let you know and we will take steps to minimise the effect of the delay.
7.4 What will happen if you do not give required information to us. We may need certain information from you so that we can supply the Ticket(s) to you, for example, your mobile telephone number or your email address. We will not be responsible for not delivering the Ticket(s) if this is caused by you not giving us the information we need.
8.1 We reserve the right to: (i) cancel and withdraw any Ticket that has been acquired, purchased, transferred, or used in breach of these terms and conditions and (ii) refuse admission to, or eject from, the Ground any person who fails to comply with these terms and conditions or the Ground Rules.
8.2 We reserve the right in the case of any breach of these terms and conditions and/or the Ground Rules, to exclude you from applying for and/or purchasing Ticket(s) and/or entering the Ground in future.
8.3 If we exercise our rights pursuant to clauses 8.1 or 8.2, no refund or compensation will be paid.
9. Limitation of Liability
9.1 If you are a Consumer:
a) the Ticket provided to you is only for your domestic and private use and you agree not to use the Ticket for any commercial or business purposes, and we have no liability to you for any loss of profit, loss of business, business interruption or loss of business opportunity;
b) if we fail to comply with these terms and conditions, we are responsible for lossor damage you suffer that is a foreseeable result of our breach of these terms and conditions or our negligence, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if it is an obvious consequence of our breach or if it was contemplated by you and us at the time that you purchased the Ticket;
c) we shall not be responsible for any interruptions and/or restrictions to your view of the match caused by virtue of: (i) the position of your seat where we have notified you before you acquired or purchased your Ticket that the seat has a restricted view; and/or (ii) the actions of players, match officials or other spectators; and
d) except as otherwise set out in these terms and conditions, and to the fullest extent permitted by applicable law, we shall have no liability in respect of any delay or failure to stage the match or delay or failure to admit you to the Ground to view the match or for anything else referred to in these terms and conditions, caused by any circumstances outside of our reasonable control.
9.2 If you are NOT a Consumer:
a) we exclude any liability for loss, injury or damage to persons/property in or around the Ground except in respect of death or personal injury resulting from our negligence or any other liability which cannot be excluded under applicable law;
b) we shall not be responsible for any interruptions and/or restrictions to your view of the match caused by virtue of: (i) the position of your seat where we have notified you before you purchased your Ticket that the seat has a restricted view; and/or (ii) the actions of players, match officials or other spectators;
c) except as otherwise set out in these terms and conditions, and to the fullest extent permitted by applicable law, we shall not have any liability in respect of any failure to carry out, or any delay in carrying out, any matter in respect of these terms and conditions, including any delay or failure to stage the match or delay or failure to admit you to the Ground to view the match or for anything else referred to in these terms and conditions, caused by any circumstances outside of our reasonable control; and
d) subject to clauses 9.2(a) to 9.2(c), our total liability in respect of our breach of these terms and conditions and/or your use of a Ticket, whether in contract, tort (including negligence), breach of statutory duty or otherwise, shall not in any event exceed the amount paid by you to us for the Ticket.
9.3 Notwithstanding any provision of these terms and conditions, we do not seek to exclude or limit our liability: (i) for fraud or fraudulent misrepresentation; (ii) for death or personal injury caused by our negligence or the negligence of any of our officers, employees or agents; or (iii) for any other matter for which it is not possible to exclude or limit liability by law.
10.1 Where to find the price for the product. The price of the Ticket(s) will be the price indicated on the order pages when you placed your order.
10.2 What happens if we got the price wrong? It is always possible that, despite our best efforts, Ticket(s) may be incorrectly priced. If we discover an error in the price of any Ticket(s) which you have ordered, we will inform you of this as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. If you choose to cancel your order and you have already paid for the Ticket(s), you will receive a full refund within 30 days.
10.3 What if the Ticket(s) are no longer available. If, for any reason other than a breach by you of these terms and conditions, we are unable to supply you the Ticket(s), for example because that Ticket is no longer available, we will inform you by email as soon as possible. If you have already paid for that Ticket, you will receive a full refund within 30 days.
10.4 When you must pay and how you must pay. We accept payment by credit card or debit card. You must pay in order to complete your order. We will carry out a standard pre-authorisation check on your payment card to ensure there are sufficient funds to fulfil the transaction. Your purchase will not be accepted until this pre-authorisation check has been completed. Your card will not be charged or debited until; the order has been accepted.
12.1 If you are a Consumer. You have legal rights if we do not comply with our obligations in these terms and conditions with reasonable care and skill. Advice about your legal rights is available from your local Citizens’ Advice Bureau or Trading Standards Office. Nothing in these Terms will affect these legal rights.
12.2 If you are NOT a Consumer:
a) you confirm that you have authority to bind the entity on whose behalf you are applying for and/or using Ticket(s);
b) these terms and conditions together with the Ground Rules constitute the entire agreement between you and us in relation to the purchase and use of Ticket(s) and supersede and extinguish all previous agreements, promises, assurances, warranties, representations and understandings between you and us, whether written or oral, relating to the same; and
c) you confirm that you are not relying on any statement, representation, assurance or. warranty (whether made innocently or negligently) that is not set out in these terms and conditions or the Ground Rules provided that nothing in these terms and conditions shall exclude our liability for fraudulent misrepresentation.
12.3 We may amend these terms and conditions. We may amend these terms and conditions and any changes will apply to Ticket(s) that are purchased or acquired after the date of the amendment. Please check these terms and conditions every time you wish to purchase or acquire any Ticket to ensure you understand the terms and rules that apply at that time. Material changes will be notified to you.
12.4 These terms and conditions are between us and each person or entity to which Ticket(s) are sold or transferred from time to time. We shall be entitled to enforce these terms and conditions against any person or entity that has acquired, held, sold, transferred or otherwise used or attempted to use Ticket(s).
12.5 We may transfer this agreement to someone else. We may transfer our rights and obligations under these terms to another organisation.
12.6 If a court finds part of this contract illegal, the rest will continue in force. Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.
12.7 Even if we delay in enforcing this contract, we can still enforce it later. If we do not insist immediately that you do anything you are required to do under these terms, or if we delay in taking steps against you in respect of your breaking this contract, that will not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date. For example, if you miss a payment and we do not chase you but we continue to provide the products, we can still require you to make the payment at a later date.
12.8 Which laws apply to this contract and where you may bring legal proceedings. These terms are governed by English law and you can bring legal proceedings in respect of the products in the English courts.
