PRTV Live Terms & Conditions
1.1 What these terms cover. These terms and conditions constitute the legal terms and conditions that apply when you access PRTV Live. They should be read in conjunction with the Premiership Rugby Digital Services Terms & Conditions, available here, which apply to your use of all of Premiership Rugby’s websites, mobile applications and other digital services.
1.2 Why you should read them. Please read these terms carefully before you submit your order to us. These terms tell you who we are, how we will provide you with access to PRTV Live, how you and we may change or end the contract, what to do if there is a problem and other important information.
2.1 Who we are. We are Premier Rugby Limited a company registered in England and Wales. Our company registration number is 3096937 and our registered office is at Regal House, 70 London Road, Twickenham, Middlesex, TW1 3QS. Our registered VAT number is 661860230. We are the organiser of Premiership Rugby and are responsible for making PRTV Live available to you.
2.2 How to contact us. You can contact us by writing to us at firstname.lastname@example.org. If you have any questions or complaints about the PRTV Live, please contact us, and we will try to resolve your complaint as quickly as possible.
2.3 How we may contact you. If we have to contact you, we will do so by writing to you at the email address assigned to your Premiership Rugby account.
3. What is PRTV Live and how do I sign up?
3.1 PRTV Live is a paid-for service that gives you access to watch selected non-televised Premiership Rugby matches live (each, a “Match”). You can purchase the following:
- a) a “Season Pass” to watch every Gallagher Premiership Rugby Match shown on PRTV Live over the course of the Gallagher Premiership Rugby season; or
- b) a “Round Pass”, which lets you watch every Match shown on PRTV Live in a particular round of Gallagher Premiership Rugby fixtures; or
- c) a “Half Season Pass” to watch every Gallagher Premiership Rugby Match shown on PRTV Live from Round 14 of the Gallagher Premiership competition; or
- d) a “Match Pass” to watch an individual Match of your choice; or
(each, a “Pass”). PRTV Live provides you with access to watch eligible matches live at the time of the match only. All Matches available as part of a particular Round Pass will be indicated on the order pages when you placed your order. 3.2 To purchase a PRTV Live Pass, simply login to your free Premiership Rugby account (or register for an account if you don’t already have one) and follow the steps to sign up for a Pass on this link. Please read the rest of these Terms & Conditions before signing up.
3.3 You have to be over the age of 18 to sign up for a Pass.
3.4 PRTV Live is not currently available in the USA, Canada, Australia and Russia. You will not be able to purchase a Pass, or access to view the live Matches you have previously purchased Passes for, while you are in these countries and you agree not to attempt to access, and not to attempt to circumvent the geo-blocking measures in place to access, PRTV Live from these territories.
3.5 What network connection do I need to watch PRTV Live? You need broadband or a mobile network to stream content from PRTV Live. You’ll need a fast enough line and an adequate broadband data allowance, and we recommend a minimum 5mb connection. If viewing PRTV Live via an internet browser, the latest browser versions are supported for Chrome, Safari, Firefox and Edge. Internet explorer is not supported. Remember that your streaming rates depend on network load in the home and could be affected by other users using the broadband connection at the same time.
3.6 Obviously, you’ll be responsible for all costs charged by your mobile network and broadband providers and your internet service provider. Remember that streaming audio-visual content can use up a lot of data, so if your broadband package doesn’t give you unlimited downloads you need to check that you have an adequate monthly data allowance.
3.7 What devices can I watch PRTV Live on? If viewing PRTV Live via a mobile device or tablet, iOS 14 and Android 6.0 operating systems are supported.
3.8 You must ensure that your device(s) meet the minimum hardware, systems and software requirements as set out above and updated by us from time to time. If your devices don’t meet these requirements, then you won’t be able to access your Pass.
3.9 Device restrictions. After purchasing a Pass, you will be able to login and watch live Matches on a maximum of one device at a time. You agree not to share your login with anyone else.
4.1 How we will accept your order. Our acceptance of your order will take place when we email you to accept it, at which point a contract will come into existence between you and us.
4.2 If we cannot accept your order. If we are unable to accept your order, we will inform you of this and will not charge you for the Pass. This might be because of unexpected issues affecting our service or because we have identified an error in the price or description of the product.
5. Price and payment
5.1 There’s no sign-up fee. You will just need to pay each time you purchase a Pass. Passes will not automatically renew.
5.2 Where to find the price for the product. The price of the Pass (which includes VAT) will be the price indicated on the order pages when you placed your order. Prices may change from time to time.
5.3 What happens if we got the price wrong. It is always possible that, despite our best efforts, a Pass may be incorrectly priced. We will normally check prices before accepting your order so that, where the Pass’ correct price at your order date is less than our stated price at your order date, we will charge the lower amount. If the Pass’ correct price at your order date is higher than the price stated to you, we will contact you for your instructions before we accept your order. If we accept and process your order where a pricing error is obvious and unmistakeable and could reasonably have been recognised by you as a mispricing, we may end the contract, refund you any sums you have paid and you’ll need to sign up for the Pass again at the correct price.
5.4 When you must pay and how you must pay. We accept payments via debit cards, all major credit cards, and PayPal. You will have to pay for the content before you access your Pass.
5.5 Promotional Offers. We may from time to time offer special promotional offers, plans or memberships (“Offers”). Offer eligibility is determined by PRL at its sole discretion and we reserve the right to revoke an Offer and put your account on hold in the event that we determine you are not eligible. Eligibility requirements and other conditions will be disclosed when you sign-up for the Offer or in other communications made available to you.
6.1 We use security and digital rights management technology for PRTV Live to protect the Matches. You must not penetrate, remove or otherwise alter or interfere with any security measures used in connection with PRTV Live, or attempt to do any of those things or assist any other person in doing or attempting to do any of those things.
6.2 You agree not to reverse engineer, de-compile, disassemble, alter, duplicate, modify, rent, lease, loan, sub-license, make copies, create derivative works from, distribute or provide others with PRTV Live or any Matches.
7. Cancellation, abandonment and rescheduling of matches
7.1 The Matches available on each Pass will be indicated on the order pages when you place your order, or for a Season Pass or Half Season Pass, will be all Premiership Rugby fixtures not televised in the season or half season. The contents of each Pass will vary from week to week depending on the round of fixtures being played that week and which Premiership Rugby fixtures are being televised.
7.2 Matches may be cancelled, postponed or otherwise made unavailable on PRTV Live (for example, because one of our broadcast partners exercises a right it may have to broadcast that Match). We don’t guarantee the availability of any Matches on PRTV Live and Matches may be cancelled, postponed or otherwise become unavailable due to broadcaster choices on short notice. In the unlikely event that a Match that formed part of a Pass is cancelled or postponed or otherwise made unavailable, we’ll aim to give you as much notice as possible.
7.3 If you bought a Match Pass and that Match is cancelled, we’ll aim to refund you for that Match Pass within three to five working days. If the Match is postponed, your Match Pass will remain valid and you’ll be able to watch the Match at the re-scheduled time and date.
7.4 If you bought a Round Pass and two or more Matches of that Round Pass are cancelled, you will be entitled to a refund by contacting us as set out above and we’ll aim to refund you within three to five working days. If the Matches are postponed, your Round Pass will remain valid and you’ll be able to watch those Matches at the re-scheduled times and dates.
7.5 If you bought a Season Pass or a Half Season Pass and [xxx Matches of that Pass are cancelled], you will be entitled to a refund by contacting us as set out above and we’ll aim to refund you within three to five working days. If the Matches are postponed, you’ll be able to watch those Matches at the re-scheduled times and dates.
7.6 In the event that a significant or material change is made to a Pass you have purchased, and the change is materially detrimental to you, then you may contact us and we will consider any refunds that may be due in respect of such Passes.
7.7 We won’t be able to refund you if you purchase a Match Pass or a Round Pass after it has been announced that the Match(es) have been cancelled or postponed.
8. Our rights to end the contract
8.1 We may end the contract if you break it. We may end the contract for a Pass at any time by writing to you if:
- a) you are in breach of this contract (including if you fail to pay any amounts due under this contract) or if we have reasonable grounds for suspecting a breach, in which case we will not refund any payments made; or
- b) if we cease to operate PRTV Live or cease to offer PRTV Live in your country, in which case we will refund you the proportionate value of your Pass if you have been unable to watch any Matches you had paid for.
9. Your rights to make changes
9.1 If you wish to make a change to the Pass you have ordered please contact us. We will let you know if the change is possible. If it is possible we will let you know about any changes to the price of the Pass, the timing or anything else which would be necessary as a result of your requested change and ask you to confirm whether you wish to go ahead with the change. If we cannot make the change or the consequences of making the change are unacceptable to you, you may want to end the contract.
10. Your rights to end the contract
10.1 You have 14 days after the day we email you to confirm we accept your order, or, if earlier, the date your Pass is activated or the date you start downloading or streaming and agreed at that point that you lost the right to cancel. This means that if you access your Pass or if it is activated within that period you expressly agree that your right to cancel will be lost. You don’t have a right to change your mind after you have accessed the service or your Pass has been activated.
10.2 To end the contract with us, please let us know by emailing us at email@example.com. Please provide your name, email address and details of the order and.
10.3 How we will refund you. We will refund you the price you paid for the Pass method you used for payment.
11. Intellectual Property
11.1 We are the owner or the licensee of all intellectual property rights in PRTV Live, and in the material available on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.
11.2 Our status (and that of any identified contributors) as the authors of content on PRTV Live must always be acknowledged (except where the content is user-generated).
11.3 You must not use any part of the content on PRTV Live for commercial purposes without obtaining a licence to do so from us or our licensors.
11.4 You agree not to copy, download, lend, hire, broadcast, stream, capture, reproduce, archive, share, distribute, modify, translate, display, transmit or make PRTV Live available to the public.
11.6 “PRTV Live” is a brand name and trade mark of Premier rugby Limited. The trade mark or any other trade mark (registered or unregistered) of Premier Rugby Limited may not be used in any manner that is likely to cause confusion among customers, or in any manner that disparages or discredits Premier Rugby Limited or any other party.
12. Our responsibility for loss or damage suffered by you
12.1 We are not responsible for delays outside our control. If our supply of PRTV Live is delayed by an event outside our control then we will contact you as soon as possible to let you know and we will take steps to minimise the effect of the delay. Provided we do this we will not be liable for delays caused by the event, but if there is a risk of substantial delay you may contact us to end the contract and receive a refund for any Pass you have paid for but not received.
12.2 We are responsible to you for foreseeable loss and damage caused by us. If we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking this contract or our failing to use reasonable care and skill[, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the contract was made, both we and you knew it might happen.
12.3 We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors; for fraud or fraudulent misrepresentation.
12.4 If defective digital content which we have supplied damages a device or digital content belonging to you and this is caused by our failure to use reasonable care and skill we will either repair the damage or pay you compensation. However, we will not be liable for damage which you could have avoided by following our advice to apply an update offered to you free of charge or for damage which was caused by you failing to correctly follow installation instructions or to have in place the minimum system requirements advised by us.
12.5 We are not liable for business losses. We only supply the products for domestic and private use. If you use the products for any commercial, business or re-sale purpose we will have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
12.6 We will make reasonable efforts to keep PRTV Live operational at all times, however we cannot guarantee that your use of PRTV Live will be uninterrupted or error-free. From time to time we may temporarily suspend or remove PRTV Live for technical, maintenance or operational reasons.
14.1 You have legal rights if we do not comply with our obligations in these terms and conditions with reasonable care and skill. Advice about your legal rights is available from your local Citizens’ Advice Bureau or Trading Standards Office. Nothing in these Terms will affect these legal rights.
14.2 We reserve the right to suspend, restrict or terminate your access to PRTV Live at any time at our sole discretion. We may also ban or suspend you as a user of PRTV Live if you do not comply with these Terms and Conditions.
14.3 We may amend these terms and conditions. We may amend these terms and conditions and any changes will apply to Pass(es) that are purchased or acquired after the date of the amendment. Please check these terms and conditions every time you wish to purchase or acquire any Pass to ensure you understand the terms and rules that apply at that time. Material changes will be notified to you.
14.4 These terms and conditions are between us and each person or entity to which Pass(es) are sold or transferred from time to time. We shall be entitled to enforce these terms and conditions against any person or entity that has acquired, held, sold, transferred or otherwise used or attempted to use Pass(es).
14.5 We may transfer this agreement to someone else. We may transfer our rights and obligations under these terms to another organisation. You may only transfer your rights or obligations under these terms to another person if we agree to this in writing.
14.6 Nobody else has any rights under this contract (except someone you pass your guarantee on to). This contract is between you and us. No other person shall have any rights to enforce any of its terms[, except as explained in Clause 15.2 in respect of our guarantee. Neither of us will need to get the agreement of any other person in order to end the contract or make any changes to these terms].
14.7 If a court finds part of this contract illegal, the rest will continue in force. Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.
14.8 Even if we delay in enforcing this contract, we can still enforce it later. If we do not insist immediately that you do anything you are required to do under these terms, or if we delay in taking steps against you in respect of your breaking this contract, that will not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date. For example, if you miss a payment and we do not chase you but we continue to provide the products, we can still require you to make the payment at a later date.
14.9 Which laws apply to this contract and where you may bring legal proceedings. These terms are governed by English law and you can bring legal proceedings in respect of the products in the English courts.
