Ellis pleaded guilty to striking former England wing Steve Hanley during Leicester's sixth round Poweregen Cup tie against Sale Sharks, while appearing in front of a RFU disciplinary panel in Coventry.
The panel susequently found that the Tigers scrum-half was not intending to injure Hanley, but found his actions reckless.
The appeal will be heard on Wednesday evening. If the ban stands Ellis will only be available for selection from 3 February, 2004, meaning he will miss all six of his club's pool matches in the Heineken Cup.
